Welcome to Surmantra. Surmantra is a brand owned and operated by SURMANTRA LLP, with its registered office at 7ES6D, 7th Floor, East Block, Mani Casadona, Action Area IIF, New Town, North 24 Parganas, Kolkata, West Bengal 700156, India ("Surmantra", "we", "our", "us"). These Terms and Conditions govern your use of this website and our services for ordering personalized custom songs.

By placing an order or using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Service Description

Surmantra provides custom, personalized song creation services. Each song is an original work made from the details and preferences you share when you order. Our writers shape the lyrics, and AI performs the voice and the instruments.

2. Order Process

  • You provide details about the song recipient, occasion, preferred genre, mood, and personal story elements.
  • Once you complete payment, our team starts writing and producing your song straight away.
  • Your song is created as an original work from the details you share.
  • You receive an email with your private Studio Pass and the gift page link, within the delivery time for your package.

3. Pricing and Payment

  • Prices are shown in Indian Rupees in India and may be shown in US dollars outside India.
  • Prices in India include GST. Nothing extra is added at checkout.
  • Payment must be completed in full before song production begins.
  • The payment methods available to you, such as cards, UPI and net banking, are shown at checkout.
  • Prices are subject to change without prior notice, but confirmed orders will be honored at the quoted price.

4. Delivery Timeline

  • All packages: within 24 hours of your order.
  • Release on Spotify and Apple Music, included in The Spotlight: the streaming services take a further 5 to 7 business days to publish the song.

Delivery times may vary with order volume. We will tell you by email if an order is going to be late.

5. Revisions Policy

  • Every package: one free swap to an alternate version of your song, requested within 7 days of delivery.
  • The Song: no revisions included. An Extra Revision add-on can be bought with the order for Rs 249 (US$25 outside India).
  • The Keepsake: 1 free revision included.
  • The Spotlight: 2 free revisions included.
  • Each revision takes up to 72 hours to complete.
  • Important: Revision requests must be submitted within 7 days of receiving the song. After 7 days from delivery, the revision window expires and no further revisions are possible.
  • Revisions are limited to minor adjustments (name pronunciation, tempo changes, small lyric tweaks).
  • Major changes to the song concept or complete rewrites are not covered under revisions and may incur additional charges.

6. Intellectual Property

  • Upon full payment, you receive a personal, non-exclusive license to use the song for personal, non-commercial purposes.
  • You may share the song with family and friends, play it at personal events, and post it on personal social media.
  • Commercial use (advertising, broadcasting, selling) requires a separate commercial license agreement.
  • The underlying composition and recording remain the intellectual property of Surmantra.

7. Content Guidelines

We reserve the right to refuse or modify orders that contain:

  • Hate speech, discriminatory content, or offensive material
  • Explicit sexual content
  • Defamatory statements about real persons
  • Content that infringes on third-party intellectual property
  • Any content that violates applicable laws

8. Cancellation

  • You can cancel an order within 10 minutes of placing it for a full refund. Email us at hello@surmantra.com with your order number within that window.
  • After 10 minutes, the order cannot be cancelled and no refund is given. Work on your song starts as soon as you order, so the service is already being performed.
  • The only exceptions are a duplicate or wrong charge, or an order we fail to deliver, as set out in our Refund & Cancellation Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Surmantra shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.

11. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new Terms.

12. Grievance Officer

In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:

We acknowledge every complaint within 48 hours and aim to resolve it within one month.
